Please read these Terms & Conditions carefully before placing an order with Food Base.
By using our website, creating an account, placing an order, purchasing meals, starting a subscription, making payment, accepting delivery, collecting an order, or otherwise using our services, you agree to be bound by these Terms & Conditions.
These Terms apply to all Food Base orders, including:
À la carte orders — one-off meal purchases, PAYG orders, individual meals, add-ons, bundles or custom orders.
Subscription orders — recurring weekly, monthly or package-based meal plans, including 5-day and 7-day packages.
Nothing in these Terms affects your statutory rights.
Food Base Limited provides freshly prepared, chilled meal-prep products for delivery or collection. Our meals are prepared in a food business environment and are designed for convenience, nutrition and general lifestyle support.
Food Base is not a medical provider, dietitian, nutrition clinic or healthcare provider. Our meals, menus, macros, calorie information, plans and guidance are not medical advice and should not be treated as such.
By placing an order, you confirm that:
you are at least 18 years old;
the information you provide is accurate and complete;
you are legally able to enter into a contract with us;
you are purchasing for personal use unless we have agreed otherwise in writing;
you understand that our products are perishable chilled food items.
We may refuse, cancel, suspend or limit orders at our discretion where we believe there is a risk of misuse, non-payment, fraud, abusive conduct, unsafe delivery circumstances, operational issues or breach of these Terms.
Placing an order does not automatically mean we have accepted it.
Your order is accepted only when we confirm it, process it, begin preparing it, allocate it to production, or take payment, whichever happens first.
We reserve the right to reject or cancel any order before production where:
payment has not been received;
payment fails, is reversed or is suspected to be fraudulent;
the order contains incorrect pricing or obvious errors;
ingredients, stock, packaging or delivery capacity are unavailable;
the delivery address is outside our service area;
the customer has previously breached these Terms;
we are unable to safely or reasonably fulfil the order.
If we cancel an order before production due to our own operational issue, we will either refund the amount paid for the affected order or offer credit at our discretion.
À la carte orders are one-off purchases and do not create an ongoing subscription unless clearly stated at checkout.
Once an à la carte order has passed the applicable order cut-off, been confirmed, paid for, allocated to production, or preparation has started, it cannot usually be cancelled, changed, refunded or transferred.
This is because our meals are perishable food products, often purchased, prepared, portioned, labelled and cooked specifically against customer demand.
We may, at our discretion, allow changes before the cut-off time, but we are not obliged to do so.
A subscription order is a recurring plan, package or payment arrangement where meals are supplied on an ongoing basis.
By starting a subscription, you authorise Food Base and/or our payment provider to take recurring payments from your chosen payment method in accordance with your selected plan.
Subscription payments are charged in advance.
Your subscription will continue until it is cancelled, paused, expired or terminated in accordance with these Terms.
You are responsible for managing your subscription, including:
checking your delivery dates;
ensuring payment details are valid;
updating your delivery address;
choosing meals where required;
notifying us of pauses or cancellations before the cut-off;
telling us about any changes that may affect your order.
Failure to use your meals, select meals, update your details, answer messages, or be available for delivery does not entitle you to a refund.
Subscription payments may be taken weekly, monthly, per delivery cycle, or in accordance with the plan selected at checkout.
By purchasing a subscription, you agree that:
payments are taken in advance;
payment dates may vary slightly due to weekends, bank holidays, processing times, payment provider rules or operational changes;
we may suspend or cancel your meals if payment fails;
we are not required to prepare or deliver meals until payment has cleared;
failed payments may result in missed meals without refund or compensation;
it is your responsibility to ensure your card, bank account or payment method remains active and funded.
If payment fails, we may reattempt payment, contact you for payment, suspend your account, cancel future deliveries, or require manual payment before resuming service.
Order cut-off times are essential because ingredients, labour, packaging, labels and delivery schedules are planned in advance.
The applicable cut-off time will be shown on our website, order page, message, invoice, checkout, subscription page or customer communication.
Unless we agree otherwise in writing, all changes, cancellations, meal selections, pauses, address changes and delivery updates must be made before the relevant cut-off.
After the cut-off:
orders are locked;
meals may enter production;
ingredients may be purchased;
labour and packaging may be allocated;
delivery planning may begin;
payment is non-refundable unless required by law or agreed by us.
We may change cut-off times from time to time due to operational requirements, bank holidays, seasonal demand, supplier changes or delivery limitations.
You may request to pause or cancel your subscription by using your account area, contacting us through the approved customer service channel, or following the cancellation process provided on our website.
To avoid being charged for your next order, you must pause or cancel before the relevant cut-off time.
Cancelling or pausing after the cut-off will not cancel any order already charged, confirmed, allocated, prepared or scheduled for delivery.
Any active order already past cut-off will still be produced and delivered where possible, and no refund will be due unless required by law or agreed by us.
Pauses are not automatically accepted unless confirmed by us or processed correctly through your account.
We are not responsible if you send a pause or cancellation request to the wrong channel, too late, or without receiving confirmation.
Where a package, monthly plan, discounted plan, promotional offer or minimum commitment applies, the terms of that offer will apply in addition to these Terms.
Unless stated otherwise:
subscription meals must be used within the relevant billing or delivery period;
unused meals do not roll over automatically;
missed meals due to customer error are not refundable;
discounted packages are non-transferable;
promotional pricing may be withdrawn or changed for future billing periods;
cancelling early may result in loss of promotional pricing, credits or discounts.
We may agree to carry over meals at our discretion, but this must be confirmed by us in writing.
All prices are shown in pounds sterling.
Prices may change at any time due to ingredient costs, supplier changes, packaging costs, inflation, delivery costs, VAT status, menu changes or operational requirements.
For à la carte orders, the price is the price shown at checkout unless there is an obvious pricing error.
For subscriptions, price changes may apply to future billing periods. Continuing to use the subscription after a price change means you accept the updated price.
We are not required to honour incorrect prices caused by website errors, system errors, third-party platform errors or obvious mistakes.
All orders must be paid in full in advance unless we have agreed alternative terms in writing.
We may use third-party payment processors. By making payment, you agree to the payment processor’s own terms and authorise them to process payment on our behalf.
You must not make false, fraudulent or unauthorised payments.
If a payment is reversed, disputed, charged back or recalled without valid reason, we reserve the right to:
suspend your account;
stop future deliveries;
recover the outstanding amount;
recover any chargeback fees or administrative costs where legally permitted;
refuse future orders;
require payment by bank transfer or another approved method.
If you believe there is an issue with a payment, you must contact us first so we can investigate.
You agree not to raise a chargeback or payment dispute without first giving us a reasonable opportunity to resolve the issue.
Where a chargeback is raised incorrectly, dishonestly, prematurely, or in relation to meals that were correctly prepared, delivered, collected, refused, missed or disposed of due to customer error, we reserve the right to challenge the chargeback and provide evidence to the payment provider.
Evidence may include order records, delivery records, tracking, photographs, messages, payment logs, subscription records, proof of production, customer communications and system records.
Delivery is available only to areas we cover.
Delivery days, times and windows are estimates unless we expressly confirm a guaranteed delivery slot in writing.
We are not liable for reasonable delays caused by traffic, weather, breakdowns, supplier issues, driver availability, road closures, incorrect addresses, customer unavailability, third-party couriers, force majeure events or circumstances outside our control.
You are responsible for ensuring:
your delivery address is complete and correct;
someone is available to receive the order where needed;
any access codes, parking details or delivery instructions are accurate;
the delivery location is safe and accessible;
meals can be refrigerated immediately after delivery.
If you provide an incorrect address, incomplete address, unsafe location, inaccessible building, wrong phone number or unavailable contact details, we may treat the order as fulfilled and no refund will be due.
If you ask us, directly or indirectly, to leave an order outside, with a neighbour, reception, concierge, gym, workplace, doorstep, porch, communal area or any other safe place, you accept the risk once the order is left there.
We are not responsible for theft, damage, tampering, weather exposure, temperature abuse, contamination, loss or spoilage after the order has been delivered to the requested or reasonable location.
If no one is available to receive the order and we reasonably leave it in a safe place, the order will be treated as delivered.
If delivery fails because of customer error, customer unavailability, incorrect information, inaccessible premises, no safe place, refusal of delivery, or failure to respond, we are not obliged to refund or replace the order.
We may offer redelivery at our discretion, subject to availability and an additional delivery fee.
Because our products are perishable, missed deliveries may need to be disposed of for food safety reasons. In that case, no refund will be due where the failed delivery was not caused by us.
If collection is available and you choose to collect, you must collect your order at the agreed time and location.
If you fail to collect your order within the agreed collection window, we may store it for a limited period where safe to do so, but we are not responsible for deterioration caused by late collection.
Uncollected meals may be disposed of for food safety reasons.
No refund will be due for orders not collected on time unless the failure was caused by us.
Once meals have been delivered, collected, left in a safe place, handed to a nominated person, or otherwise made available to you, responsibility for storage and handling passes to you.
You must refrigerate meals immediately.
You must follow all storage, use-by, reheating and consumption instructions provided on the label, packaging, website or customer communications.
We are not responsible for illness, spoilage, quality issues or safety issues caused by:
delayed refrigeration;
incorrect storage;
leaving meals at room temperature;
freezing meals incorrectly;
reheating incorrectly;
eating meals after the use-by date;
damaged packaging after delivery;
customer mishandling;
third-party handling after delivery;
ignoring label instructions.
Our meals are fresh chilled products.
You must check each label or instructions on site before eating.
Unless stated otherwise:
meals must be kept refrigerated under 5 degrees celsius;
meals must be consumed by the stated use-by date;
meals must be reheated until piping hot throughout where reheating is required;
meals must not be reheated more than once;
meals must not be eaten if the packaging is damaged, swollen, leaking, unusually smelling, visibly spoiled or past its use-by date.
If you choose to freeze meals, you do so at your own risk unless we have expressly stated that the meal is suitable for freezing. Meals should only be frozen before the use-by date and should be defrosted and reheated safely.
Food Base handles, prepares and stores ingredients in environments where allergens may be present.
Our meals may contain, or may come into contact with, allergens including but not limited to: cereals containing gluten, milk, eggs, fish, crustaceans, molluscs, peanuts, nuts, sesame, soya, mustard, celery, sulphites and lupin.
We take reasonable care with allergen information, but we cannot guarantee a completely allergen-free or cross-contamination-free environment.
If you have a food allergy, intolerance, medical dietary requirement, religious dietary requirement, pregnancy-related dietary requirement or serious sensitivity, you must tell us before ordering and must check the suitability of each meal before eating.
You must check the label on each individual meal before consumption. Labels and ingredients may change.
Substitutions, menu changes and supplier changes may alter ingredients, allergens, calories and macros.
We are not liable for allergic reactions, intolerance reactions or dietary issues where:
you did not disclose the relevant requirement before ordering;
you failed to check the label before eating;
the product was consumed by someone other than the customer;
the meal was substituted and the label identified the ingredients;
cross-contamination risk was communicated;
the reaction was caused by customer mishandling or third-party handling.
If you are unsure whether a meal is suitable, do not eat it. Contact us before consumption.
We aim to supply the meals ordered, but availability may change due to ingredient shortages, supplier issues, quality control, operational problems, menu changes, seasonality or unexpected demand.
We reserve the right to substitute ingredients, sides, vegetables, sauces, garnishes, packaging or whole meals with a reasonable alternative.
Where possible, substitutions will be broadly similar or suitable for the relevant package, but they may have different ingredients, allergens, calories, macros, texture, taste or appearance.
It is your responsibility to check the label or nutritional info on website before eating.
If you have allergies or strict dietary requirements, you must contact us before ordering and before consuming substituted items.
Calories, macros and nutritional information are estimates only.
Although we aim to be accurate, natural variation occurs due to ingredient differences, supplier changes, cooking methods, portioning tolerance, moisture loss, sauce distribution, trimming, weighing variation and recipe updates.
Nutrition information should not be relied on as medical, clinical or competition-level advice.
If you require precise nutrition for medical, bodybuilding, athletic, weight-cutting, allergy, pregnancy or health reasons, you should seek professional advice before ordering.
We are not liable for weight gain, weight loss failure, performance outcomes, body composition outcomes, water retention, digestive response or any health result linked to consuming our meals.
Food Base meals may support a customer’s general nutrition goals, but results are not guaranteed.
You acknowledge that:
weight loss is not guaranteed;
muscle gain is not guaranteed;
body recomposition is not guaranteed;
health improvements are not guaranteed;
calorie targets may not suit every person;
you are responsible for your wider diet, exercise, lifestyle and health decisions.
You should seek medical advice before ordering if you are pregnant, breastfeeding, under medical supervision, under 18, elderly, immunocompromised, diabetic, recovering from illness, managing an eating disorder, have kidney disease, have food allergies, or have any other medical condition.
You must inspect your order as soon as possible after delivery or collection.
Any issue with missing items, incorrect meals, damaged packaging, delivery problems, quality concerns or suspected spoilage must be reported to us as soon as possible and no later than 24 hours after delivery or collection, unless the issue could not reasonably have been discovered within that time.
For any food safety, quality or missing item complaint, we may require:
clear photographs;
the product label;
batch details;
delivery details;
order confirmation;
packaging photographs;
a description of the issue;
return of the affected product where safe and practical.
You must not dispose of the affected item before giving us a reasonable opportunity to review it, unless there is a food safety reason to do so.
Failure to provide evidence may limit our ability to offer a refund, credit or replacement.
Because our meals are perishable food products, refunds are not offered for change of mind, customer error, missed cut-offs, incorrect orders, dislike of taste, failure to follow storage instructions, failure to follow reheating instructions, missed delivery, late collection, wrong address, or failure to cancel a subscription in time.
Where we accept responsibility for an issue, our usual remedy will be one of the following at our discretion:
replacement of the affected item;
credit against a future order;
partial refund for the affected item;
full refund for the affected item.
We are not required to refund an entire order where the issue affects only part of the order.
Refunds will not exceed the amount paid for the affected item or affected order.
We do not provide compensation for inconvenience, loss of enjoyment, loss of time, loss of earnings, third-party costs, consequential losses or indirect losses.
Nothing in these Terms limits your statutory rights where goods are faulty, not as described, or where we are not legally permitted to limit liability.
Most online purchases have cancellation rights under UK consumer law. However, certain goods are excluded, including goods that are liable to deteriorate or expire rapidly.
Our meals are fresh, chilled, perishable food products. As a result, once an order has been accepted, prepared, allocated to production, dispatched, delivered, collected, or passed the applicable cut-off, cancellation rights may not apply.
This does not affect your rights where we have supplied faulty goods, goods that are not as described, or where the law does not allow us to exclude liability.
If you refuse delivery of an order that was correctly prepared and delivered, no refund will be due.
If you refuse an order because of an issue caused by us, you must contact us immediately and provide evidence of the issue.
Because meals are perishable, refused orders may be disposed of and cannot always be redelivered.
We aim to provide professional service and expect customers to communicate respectfully.
We reserve the right to refuse, suspend or cancel service where a customer:
is abusive, threatening, discriminatory or aggressive;
harasses staff, drivers, suppliers or other customers;
repeatedly makes unreasonable complaints;
repeatedly raises invalid chargebacks;
provides false information;
misuses discounts or promotions;
attempts to obtain refunds dishonestly;
breaches these Terms.
Where service is cancelled due to customer misconduct, we may refund only amounts paid for orders not yet produced, less any reasonable costs already incurred.
Promotions, discounts, referral codes, goodwill credits and special offers are offered at our discretion.
They may be withdrawn, amended or refused at any time.
Unless stated otherwise:
discounts cannot be exchanged for cash;
discounts cannot be backdated;
only one discount may be used per order;
discounts may not apply to delivery, seafood upgrades, XL upgrades, add-ons or subscriptions;
credits may expire;
credits are non-transferable;
abuse of promotions may result in cancellation of orders or accounts.
Delivery fees, packaging fees, seafood supplements, XL upgrades, add-ons, special requests and other charges will be shown where applicable.
Additional charges may apply for:
redelivery;
address changes after cut-off;
failed deliveries;
special delivery requests;
bespoke orders;
out-of-area deliveries;
replacement orders caused by customer error.
We will not charge additional fees unless they are shown at checkout, agreed with you, or permitted under these Terms.
Bespoke, custom, corporate, wholesale, event, gym stocking, bulk or special orders may be subject to separate terms.
Unless we agree otherwise in writing:
bulk orders require advance payment;
deposits are non-refundable once ingredients, labour or production have been allocated;
changes must be requested before the agreed cut-off;
cancellation after confirmation may result in loss of deposit or full charge;
delivery and storage responsibility passes on delivery or collection;
resale is not permitted unless approved by us in writing.
You must not misuse our website, ordering system, payment system, account area or communications.
You must not:
attempt to hack, disrupt or interfere with the website;
upload malicious code;
scrape or copy content without permission;
use false details;
impersonate another person;
make fraudulent orders;
use our content, photos, branding or meal descriptions for commercial purposes without permission.
We may suspend access to the website or customer account where misuse is suspected.
All Food Base branding, logos, photographs, videos, recipes, meal names, menu descriptions, website content, packaging designs, social media content, copy, graphics and business materials belong to Food Base Limited or its licensors.
You may not copy, reproduce, distribute, sell, imitate, modify or commercially use our intellectual property without written permission.
Customer reviews, tags, testimonials, photographs or social media posts that mention Food Base may be shared by us for marketing purposes unless you tell us otherwise in writing.
We may use third-party platforms for ordering, payments, delivery, subscriptions, email, SMS, website hosting, analytics or customer communication.
We are not responsible for third-party outages, errors, delays or failures outside our reasonable control.
Your use of third-party platforms may also be subject to their own terms and privacy policies.
We process personal data in accordance with our Privacy Policy.
We may use your personal information to:
process orders;
take payment;
deliver meals;
contact you about your order;
manage your subscription;
handle complaints;
comply with food safety, legal and accounting obligations;
improve our service;
send marketing where permitted.
You are responsible for keeping your account details accurate and up to date.
Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or breach of statutory rights that cannot legally be excluded.
Subject to that, Food Base will not be liable for:
indirect losses;
consequential losses;
loss of profit;
loss of business;
loss of opportunity;
loss of goodwill;
loss of enjoyment;
loss caused by customer error;
loss caused by incorrect storage or reheating;
loss caused by third-party handling after delivery;
loss caused by events outside our reasonable control.
Our total liability for any order will not exceed the amount paid for the affected item or affected order, except where the law requires otherwise.
We are not responsible for failure or delay caused by events outside our reasonable control, including but not limited to:
supplier failure;
ingredient shortages;
packaging shortages;
staff illness;
kitchen issues;
equipment failure;
power cuts;
transport disruption;
traffic;
severe weather;
accidents;
courier failure;
strikes;
government restrictions;
food safety incidents;
pandemics;
system outages;
payment provider issues;
events that make production or delivery unsafe or impractical.
Where this happens, we may cancel, delay, substitute, reschedule or refund affected orders at our discretion.
We may update these Terms from time to time.
The latest version will be available on our website.
For one-off à la carte orders, the Terms in force at the time of order will usually apply.
For subscriptions, updated Terms may apply to future billing periods. Continuing to use the subscription after updated Terms are published means you accept the updated Terms.
If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be removed or limited to the minimum extent necessary, and the rest of the Terms will remain in force.
If we do not enforce any part of these Terms immediately, this does not mean we have waived our right to enforce it later.
Any goodwill gesture, refund, replacement, credit or exception offered by us does not create an obligation to offer the same remedy again.
These Terms are governed by the laws of England and Wales.
Any dispute will be subject to the courts of England and Wales, unless consumer law gives you the right to bring proceedings elsewhere.
